1. Acceptance of Terms

By accessing or using Preschoolio ("the Service"), with principal place of business at Ground Floor, No. 45, Shakthi, Kattigenahalli, Yelahanka, Bengaluru – 560064, Karnataka, India (GSTIN 29CYNPS8608B1ZX), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to all of these terms, please do not use the Service. These terms constitute a legally binding agreement between you and Preschoolio.

2. Eligibility & Parental Responsibility

Preschoolio is intended for use by children aged 3–6 under the active supervision of a parent or guardian who is at least 18 years old. By creating an account, you confirm that:

• You are a parent or legal guardian of the child using the Service.
• You accept full responsibility for your child's use of the Service.
• You have provided accurate information during registration.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use Preschoolio for personal, non-commercial educational purposes only. You may not:

• Copy, reproduce, distribute, or resell any content from the Service.
• Reverse-engineer, modify, or create derivative works of the app.
• Use the Service for any commercial purpose without our written consent.

4. User Accounts

To access certain features, you must create a parent account using a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately at hello@preschoolio.com if you suspect unauthorized use of your account.

5. Subscriptions, Payments & Auto-Renewal

Certain features require a paid subscription. By subscribing, you agree that:

• Payments are charged in advance for the selected billing period (monthly or annually).
• Subscriptions automatically renew at the end of each period unless cancelled before the renewal date.
• Payments are processed by secure third-party providers — Razorpay for web purchases and Google Play Billing for in-app purchases on Android. We do not see or store payment card or bank-account details.
• Prices may change with 30 days' notice. Continued use after a price change constitutes acceptance.

6. Cancellation & Refunds

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access until then.

• Monthly subscriptions: No refund. Access will continue till the expiry.
• Annual and Lifetime purchases: Request refund within 5 days, otherwise no refund policy, access will continue till the expiry.

For purchases made via Google Play, refunds are subject to the Google Play refund policy.

7. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable local, national, or international law.
• Attempt to gain unauthorized access to any part of the Service.
• Transmit any harmful, offensive, or inappropriate content.
• Use automated tools or bots to access or scrape the Service.

8. Intellectual Property

All content on Preschoolio — including games, artwork, audio, characters, and branding — is the exclusive intellectual property of Preschoolio and its licensors. Unauthorized use, reproduction, or distribution is strictly prohibited.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation.

10. Limitation of Liability

To the fullest extent permitted by law, Preschoolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

Statutory rights preserved. Nothing in these Terms limits, excludes, or modifies any consumer right, guarantee, or remedy that cannot be excluded under the Consumer Protection Act, 2019, the Digital Personal Data Protection Act, 2023, or any other mandatory law applicable in your jurisdiction. Where any provision of these Terms is unenforceable against you under such law, the remaining provisions continue to apply.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, Karnataka, India. We encourage you to contact us first to resolve any issue amicably.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice within the app. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
